1. Introduction

Welcome to Readymix Concrete US. These Terms & Conditions govern the sale and supply of all concrete products (“Products”) provided by Readymix Concrete US (“Supplier”) to the customer (“Customer”). By placing an order with us, the Customer agrees to be bound by these terms.

2. Agreement and Acceptance

The contract between Supplier and Customer commences when an order is accepted or delivery is made. No variations to these Terms are binding unless expressly agreed in writing by an authorized representative of the Supplier.

3. Prices and Payment Terms

Prices quoted exclude taxes unless stated otherwise. Payment is due within 30 days of invoice date unless arranged differently in writing. Supplier reserves the right to charge for additional costs such as wait times, extra stops, or deliveries outside regular hours.

4. Product Specifications

Products will be supplied to the specifications agreed upon in the contract or sales documentation. Customer acknowledges that images or descriptions are guides only and do not form part of the contract unless expressly stated.

5. Orders and Delivery

The Customer must provide accurate delivery information. Delivery dates are estimates and time is not of the essence. The Customer or their representative must be available to receive and sign for the delivery. Delivery batches are independent; failure to deliver a batch does not cancel the entire contract.

6. Customer Obligations

Customers must ensure a safe access route for delivery trucks and that site conditions are suitable for delivery. Any delays or damages caused by unsafe conditions may incur additional charges.

7. Quality and Testing

All concrete products are subject to rigorous quality control and testing at the time of delivery. The Customer acknowledges the right of the Supplier to make minor adjustments to mixes to comply with standards.

8. Risk and Title

Risk passes to the Customer upon delivery to the specified location. Ownership remains with the Supplier until full payment is received.

9. Cancellation and Returns

Orders must be canceled at least 24 hours prior to delivery to avoid cancellation fees. Returns of concrete products are not accepted due to the nature of the product.

10. Liability

Supplier’s liability is limited to the replacement of faulty goods or refund of the purchase price. Supplier is not liable for indirect or consequential losses.

11. Force Majeure

The Supplier is not liable for failure or delays caused by events beyond its reasonable control including natural disasters, labor disputes, or changes in government regulations.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, and any disputes shall be subject to the jurisdiction of the courts in the Supplier’s principal place of business.
